Dear Mr. Obama, the Congress of the United States and Senor Calderon,

How's this for COMPREHENSIVE IMMIGRATION REFORM:

1. Any individual who shall enter into the United States or any of its possessions or territories without compliance to the immigration statutes of the United States, hereafter referred to as an illegal alien, shall have no claim to the rights and protections granted to citizens of the United States, legal immigrants to the United States, resident legal aliens, and such other individuals legally in the United States under the Constitution of the United States.

2. Any individual who shall enter into the United States or any of its possessions or territories without compliance to the immigration statutes of the United States, hereafter referred to as an illegal alien, shall be guilty of a felony punishable by:

A. Imprisonment for a mandatory period of not less than 5 years in a federal prison unless:

i. The country of which the felon is a citizen of agrees to:

a. Recompense the United States for all costs involved in the arrest, prosecution, and imprisonment of the felon.

b. Pay for the expense of returning the felon to their country of origin and accept the felon back to their country of origin.

ii. In which case the felon shall be returned to their country of origin.

B. Confiscation of all property, real or otherwise, and monies of the felon or transferred to any third party in an attempt to illegally shelter it, in the opinion of a federal court, from this provisions of this statute.

C. Shall be immediately deported from the United States, its possessions, or its territories upon completion of their term of imprisonment and shall be permanently banned from entry into the United States, its possessions, and its territories.

D. The United States born children of any illegal alien shall be disbarred from receiving United States citizenry as a result of birth within the boundaries of the United States, its possession, or territories and shall remain citizens of the nation of their parents legal residence.

3. Any individual who shall enter into the United States or any of its possessions or territories, hereafter referred to as an illegal alien,a second time shall be guilty of a felony punishable by:

Imprisonment for a mandatory period of not less than 10 years in a federal prison.

4. Any individual who shall enter into the United States or any of its possessions or territories, hereafter referred to as an illegal alien, a third time shall be guilty of a felony punishable by:

A. Imprisonment for a mandatory period of not less than 25 years to life in a federal prison.

5. Any owner business which employs one or more individuals as described in Sections 1, 2, or 3 of this statute shall be guilty of a felony punishable by:

A. Imprisonment for a period of not less than 1 year in a federal prison.

B. A mandatory fine of not less than $1,000,000.

C. Registration as Immigration Offender upon completion of their term of imprisonment and:

i. Be required to keep the Department of Immigration or its successors informed of their residence, name, business ownership, or employment and any change in residence, name, business ownership, or employment.

ii. Re-register with the Department of Immigration annually on their date of birth for life.

D. Disbarment from running for or election to, or appointment to, or employment in or by any local, municipal, state, or federal office.

6. Any individual who aids or abets, or conspires to aid or abet, any individual or illegal alien in the commission of a violation of any provision of this statute shall be guilty of a felony punishable by:

A. Imprisonment for a period of not less than 1 year in a federal prison.

B. A mandatory fine of not less than $1,000,000.

C. Registration as Immigration Offender upon completion of their term of imprisonment and:

ii. Re-register with the Department of Immigration annually on their date of birth for life.

D. Disbarment from running for or election to, or appointment to, or employment in or by any local, municipal, state, or federal office.

7. Any individual elected, appointed, or employed to or in any local, municipal, or federal public office who aids and abets any individual defined in Sections 1, 2, 3, 4, 5, or 6 of this statute to violate this statute or through legislation, act, or decree under the colour of the authority of their elected, appointed, or employed office or position shall be guilty of a felony punishable by:

A. Immediate removal from their elected, appointed, or employed office.

B. Imprisonment for a mandatory period of not less than 1 year in a federal prison.

C. A mandatory fine of not less than $1,000,000.

D. Disbarment from running for or election to, or appointment to, or employment in or by any local, municipal, state, or federal office.

E. Registration as Immigration Offender upon completion of their term of imprisonment and:

ii. Re-register with the Department of Immigration annually on their date of birth for life.

8. Any municipality or jurisdiction which, through legislation, act, decree, proclamation, or statute aids and abets any individual defined in Sections 1, 2, 3, 4, 5, or 6 of this statute to violate this statute or through legislation, act, decree, proclamation, or statute or under the colour of the authority of their municipal authority causes law enforcement officers or courts to circumvent this statute or any component of this statute or which declares itself, for the purpose of circumvention of this statute, a "sanctuary" for illegal aliens shall be in violation of federal law and punishable by:

A. The immediate cancellation of any support or benefit associated with any federal program or funding that the municipality may be, at the time of such violation, receiving.

B. Being declared ineligible, for a period of 5 years, for participation in any federal funding or benefits of any federal programs that the municipality maybe otherwise eligible for.

C. The governing body of such municipalities that violate this section of this statute shall be subject to prosecution under Section 7 of this statute.

Hooray for Governor Jan Brewer and the people of Arizona for passing the toughest illegal immigration bill in the nation and boo to Mr. Obama for his characterizing this brave stance as irresponsible and un-American . . . "That includes, for example, the recent efforts in Arizona, which threaten to undermine basic notions of fairness that we cherish as Americans, as well as the trust between police and their communities that is so crucial to keeping us safe.”. No, Mr. Obama you and Congress are the ones that are irresponsible . . . you're too busy circumventing Article 1 section 18 and the 10th amendment, regulating everything from how much salt we use on our French fries to which cars we drive, and enriching yourselves and your buddies from the national treasury to fulfill the most basic functions of government; protection of our borders, our people, and our sovereignty and it is YOU that " . . . undermine basic notions of fairness that we cherish as Americans, as well as the trust between police and their communities that is so crucial to keeping us safe.” .

"But you don't understand this is racial profiling!", okay it is . . . so what? Law enforcement uses profiling (and yes "racial" profiling) every day. If they didn't we'd never apprehend any criminals. If three 6 foot white men with red hair wearing yellow shirts rob a bank does law enforcement start looking for dark haired Chinese midgets wearing red shirts? No, they start looking for individuals who fill the description (profile, "racial" profile) of the perpetrators. In the case of criminal aliens (and that's exactly what these people are . . . criminals according to Title 18 of the U.S. Code) they are millions of dark haired Hispanics who have no, or limited, English facility and who, typically, look for low paying day jobs or hang around "day job" pick-up points; they are not red headed Irishmen with brogues (by the way it wasn't red headed Irishmen with names like Paddy O'brien that blew up the Twin Towers, killed three thousand innocent people, and is threatening America . . . no, it's dark haired Muslims with names like Mohamed Osama Obama that are the enemy) so it only makes sense to start with individuals who fit the description (profile, yes even "racial" profile) when attempting to identify, apprehend, and prosecute these criminals.

"These are just poor people coming here to seek work, and if we arrest and deport them all our economy would collapse, besides this law violates their civil rights!". The reasons illegals are here have no more relevance than do the reasons any other criminal commits his/her crime . . . they are violating U.S. law. 'Our economy would collapse. . . .' is a liberal myth that ranks right up there with "Illegals do jobs Americans don't want to" . . . there is no empirical evidence that supports such a statements, until every American citizen has been interviewed and offered the jobs and have turned down those jobs being done by these criminal aliens you cannot support the statement that '. . . they do the work Americans don't want to do.'. And as far as I'm concerned, since the constitution starts with "We the people ... of the United States . . . " and not "We the people of the United States and anyone illegally here . . ." these criminal aliens do not have any Constitutional rights.

"You don't mean that . . . that's racist!". No, it's not racism and no I'm not a racist. During the 1960s I was one of those people who stood up for equal and civil rights when it wasn't popular nor safe to do so. I've seen firsthand what racism is; expecting that our national (and state) borders, our laws, and our national interests be respected in the face of "political correctness" and political ambition IS NOT racism it's a reasonable expectation.

"That's just an excuse for your xenophobia!". You obviously don't know the meaning of xenophobia! First of all xenophobia is an UNREASONABLE fear or hatred of foreigners or strangers or of that which is foreign or strange; the key word being "UNREASONABLE". It is ultimately REASONABLE to fear the negative social and economic consequences of criminal immigration and the loss of control over our national and state borders we are experiencing. Moreover, resorting to accusations of xenophobia, sexism, racism, etc. ... are common ploys of liberals who have no factual evidences for their beliefs, who can't think of any more lies and half truths to use, whose attempt to over-talk or shout down an opponent have failed, and is losing a debate . . . such phrases are designed to frighten/embarrass an opponent into silence and they don't work if one is not a xenophobe, sexist, nor racist and has the intelligence to recognize those epithets for what they are and simply deny them.

"But all of the American southwest including California, Colorado, Montana, and Utah originally belonged to Mexico and the United States 'stole' it all from Mexico in the illegal land grab we call the Mexican War . . . they have more right to be here than Anglos do!". That just plain ignores history! Historically all sovereignty over territory has been based on conquest and by one people defeating another . . . as to these lands, the U.S. gained sovereignty over them by conquering the territory and defeating the Mexican Army/government . . . the Mexican (government) gained sovereignty over the territory of Mexico (including the AMERICAN Southwest, California, Colorado, Montana, and Utah) by defeating the French, the French gained sovereignty over Mexico by defeating the Spanish, the Spanish gained sovereignty over Mexico by defeating (primarily) the Aztecs, and if memory serves me, the Aztecs gained sovereignty over Mexico by defeating the Olmecs (amongst other indigenous people) . . . do I need go on to each country throughout the world? For the most part, in my humble opinion and as supported by all human history, most wars are basically "land grabs".

"America was built by immigrants!". For once something we can agree on. My ancestors, like the millions of other LEGAL immigrants that built this nation, came here LEGALLY . . . they were forbidden by law from being on the public dole, they learned English, they were net CONTRIBUTORS to their new county not net DETRACTORS, in short they complied fully with Title 18. The people you are talking about deserve no more compassion than does the burglar in the night or the armed robber on the street; their children have no more claim to citizenship than does the children of the bank robber have a claim to the money that the robber steals from the bank. Let me make this point clear . . . I welcome all LEGAL immigrants; their cultures, their hard work, their innovations, their respect of our laws, and their contributions are what made this nation great but those that are here ILLEGALLY are just plan criminals and should not be afforded the rights of citizens or those extended to those individuals here legally but are deserving only of the punishment afforded to any other common criminal.

By the way I am an AMERICAN of Italian immigrant decent and one who is unashamedly proud of his heritage as both an American and a descendant of LEGAL Italian immigrants.

The basic facts that bleeding heart liberals can't seem to understand is that (1) every nation has the right to be secure within and exercise control over their boarders (2) what "undocumented immigrants" are doing by being here without compliance to Title 18 is a criminal act making these people criminals (3) most of these criminal aliens commit more criminal acts (identification theft being most predominate) (4) criminal aliens are, contrary to liberal propaganda, a net drain on the U.S. economy; they use disproportionally more public services, they overwhelm and overburden our emergency medical facilities unnecessarily, and rely more on "entitlement" programs than does the general population . . . need I go on?".

Back during The Great Depression, President Herbert Hoover ordered the deportation of ALL illegal aliens in order to make jobs available to American citizens that desperately needed work.

Harry Truman deported over two million Illegal's after WWII to create jobs for returning veterans.

And then again in 1954, President Dwight Eisenhower deported 13 million Mexican Nationals! The program was called 'Operation Wetback' (look it up on the internet). It was done so WWII and Korean Veterans would have a better chance at jobs. It took 2 Years, but they deported them!

The Reagan Immigration Reform and Control Act of 1986 gave amnesty to 2.6 million criminal aliens and today we have 12 million more criminals are protesting in our cities under Mexican flags demanding amnesty and the national government is on the verge of giving it to them.

Mr. Obama, amnesty DOES NOT work . . . have the courage of Hoover, Truman, and Eisenhower and support Governor Brewer and Arizona and do your job!

They Need Us, We Don't Need Them

O.K., so usually my rants are strictly political but tonight, while watching the news, I heard one news filler that set me off; RyanAir (an Irish/British airline) announced that they are going to begin charging passengers 1 pound (that's $1.40 American) to use the loo (that's bathroom for us yanks). This followed closely on the heels of another filler that informed the world that Spirit Air (a cut-rate American airline) would begin charging $40 for passengers "carry-ons" stored in "overheads". These follow closely after, within the last week, various American air carriers announcing they would begin charging passengers as much as $100 to allow them to pick a seat which even overshadowed their extorting per bag charges from fliers. Airlines jacking up prices and charging (now) for everything from taking a . . . well you know, to pillows, blankets and meals while reducing service and treating their customers like just so much air freight and, at times, forcing them to sit on airport tarmacs for hours in deplorable conditions have become the norm.

My question is what the heck has happened to this world . . . its seems to have been turned upside down. Airlines, merchants, and yes government officials seem to have forgotten the basics . . . THEY NEED US, WE DON'T NEED THEM!

We don't need the airlines and we need to prove it to them; the other day I was having a conversation with a friend of mine and he was "going off" about the outrageous prices and practices of the air lines then without taking a breath he began telling me about a vacation he was planning which included airline flights! Come on people . . . the airlines are going to continue pulling their bull as long as we, the consumer, let them get away with it . . . let's regain control. DON'T FLY, no excuses just don't do it you don't have to . . . vacation close to home or someplace you can drive to (just think what a boom to our local economy it would be if you spent your vacation dollars within driving distance of your home!) and if you absolutely HAVE to fly and you find yourself on one of those flights that are stuck on the tarmac for hours; get an attorney and sue the airline for unlawful imprisonment; your ticket DOES NOT entitle them to hold you captive! If you're a businessperson, don't fly . . . you live in the 21st century IT IS possible (not to mention cheaper) to do most business and conduct most meetings, which used to be done by traveling to remote destinations, over the internet and through video/teleconferencing. If your flights are late contact the airline and demand a refund or a CASH consideration for your inconvenience and if you don't get it FILE A COMPLAINT with the FAA . . . you can do it online in just a couple of minutes. I can almost guarantee you that the airlines, when faced with bankruptcy and answering FAA complaints, will change their policies and return to serving the public, free meals, and free luggage . . . THEY NEED US, WE DON'T NEED THEM!

We don't need any particular merchant either and we need to prove it to them. Last week I was in a major, "large box" merchant standing in the only open check-out line, of the 16 check-out lines in the store, with a cart full of merchandise I was trying to buy along with about 6 other people similarly loaded up while store employees wandered about "picking their noses" (so to speak) and completely ignoring the situation . . . what the heck kind of idiot was I (I won't speak for the other people in line)! Here I was putting up with this c**p so I could have the privilege of giving THEM several hundred dollars of MY money for THEIR merchandise! Whatever happened to customer service and "the customer is king"? We've let merchants turn the tables on us; that's what has happened! Let's put things back into proper perspective . . . let's vow that next time we find ourselves in a similar situation we DEMAND that another register be opened NOW and if it isn't instantly acted on leave your cart in line full with the merchandise we would have purchased in it and just walk away to another store where we might get treated as a valued customer. I can almost guarantee you that when merchants realize the loss of patrons and dollars they are suffering they'll change their policies and return to serving the public . . .THEY NEED US, WE DON'T NEED THEM!

Our national elected officials, and the people they have appointed, have gone from being "servants of a (free) people" responding to and being directed by the people served to being rulers of a nation of virtual serfs dictating to us every facet of our lives from how much water we use to flush our toilets to imposing upon us dependencies on hostile nations for our energy needs. They rob our treasury to support fantasy technologies which, in turn, themselves are supported by junk science and are propagandized by lies and half truths and supported by the politics of fear while lining many of their own, as well as the pockets of their friends and tell us the whole time that they know better than us what is good for us. Let's re-establish the proper relationship between servants (government officials) and masters (the people) by voting out every incumbent who has served, or is attempting to serve, more than two terms. I can almost guarantee you that after 2 or 3 electoral cycles office holders will get the message, be a servant or be unemployed, and will return to being servants of the people. . . THEY NEED US, WE DON'T NEED THEM!

The Second Civil War

As I sit and write this the American people are on the eve of a second Civil War, not one which will be fought with shot, powder, and bayonets but with votes; the polling places of election day 2010 will be the Fort Sumters of this new conflict and Americans need to wield their votes as if they were bayonets to excise the cancer that has infected the body government.

The events leading up to, and the actions of the President and the Congress, on March 21 2010 underscore the ever widening disconnect between those that govern and those that are governed. And it is the exemplar of what happens when those that are elected to be governors and to govern by the consent of the governed morph themselves into rulers that rule against the will of the ruled. Thomas Jefferson warned us of this when he said " Every government degenerates when trusted to the rulers of the people alone. The people themselves are its only safe depositories.".

As this first battle approaches we need to be clear on the battle lines and of the causes of this rebellion. We should not allow this issue to devolve into a partisan battle; this is the way cynical and corrupt politicians have kept us divided and weakened in the past.

This is not a civil war between Democrats, Republicans, and/or Independents . . . it is rebellion against both corrupt, arrogant, and non-responsive legislators and a Federal central government that continually ignores the delineated limitations on its powers as enumerated in Article 1 Section 8 of the Constitution and which usurps the powers of the states as granted in the 10th Amendment of the Constitution. President Washington warned us against such usurptions in 1796 when he said "If in the opinion of the People, the distribution or modification of the Constitutional powers be in any particular wrong, let it be corrected by an amendment in the way which the Constitution designates. But let there be no change by usurpation; for though this, in one instance, may be the instrument of good, it is the customary weapon by which free governments are destroyed.".

The cause of this rebellion isn't simply an ill-conceived healthcare bill, that's just the match that lit the fuse; the real cause is not one but many causes. It is found in the steady and consistent progression away from rule by, and perversion by interpretation of, the Constitution; it found in the rabid environmentalism which has crippled the American economy and endangered American sovereignty by denying us the intelligent and beneficial exploitation of our abundant energy sources and has, directly or indirectly, lead to the death of thousands of American servicemen and women in the protection of America's access to foreign sources of energy resources.

It is found in the unprecedented intrusion of the government into every aspect of our lives. I agree with Thomas Jefferson when he said "My reading of history convinces me that most bad government results from too much government." and would add that it is time for us to enforce the limits on government by voting out and impeaching those that would expand its invasiveness beyond that which was originally envisioned in the un-"interpreted" Constitution.

It is found in the progressive and repressive creep of the Federal government to the left and towards socialism over the last 100 years with the accompanying cynical economic enslavement of an ever growing segment of the population (and the electorate) through the expansion of "entitlement" programs; it is the growing disgust of the American people to the backroom wheeling and dealing, blatant (legalized?) bribery, the draconian penalization of the most productive members of our society for their productivity while rewarding of the least productive in a thinly veiled attempt to buy votes and retain power that are causative. I fear that today the words spoken by President Jefferson over 200 years ago are threatening to prove true "The democracy will cease to exist when you take away from those who are willing to work and give to those who would not.".

During the debate over the healthcare bill the statement was made ". . . The system is broken and we need to fix it. . .". This was the only statement made that I found merit in although the "we" the speaker was talking about was Congress and I firmly disagree with that "we". It's too late for that "we", they had their chance and have, over and over again, proven not to be up to the challenge . . . we, the American people, need to take up the task by firing "da bums". Some need to be fired for what they've done (their corruption, incompetency, political correctness, their anti-Americanism) and others, perhaps more importantly, for what they failed to do (stop the corruption, expose the incompetency, kill the political correctness, and perpetuate Americanism). We limit the President of the United States to 2 4-year terms why should we then not set term limits on the Congress and the Supreme Court. For the former, since the expectation that these "fat cat" professional politicians will vote to limit their own terms is unrealistic, we must enforce term limits upon them by never re-electing any candidate that has served two consecutive terms and for the latter by demanding a constitutional amendment that limits a justices' terms to one 8-year term. I look forward to the day the most senior member of Congress has less than eight years under his/her belt. Mr. Jefferson predicted the danger of "professional politicians" when he said "Experience hath shewn, that even under the best forms of government those entrusted with power have, in time, and by slow operations, perverted it into tyranny.".

It is time that we, the people and government of the United States, begin to think not as Republicans, Democrats, or Independents but as Americans.

The day the recent healthcare bill passed the anger felt by over 70% of the American people made itself known, my hope is that we do not allow it to dissipate between now and November and we manifest it at the polls. Please remember, "All tyranny needs to gain a foothold is for people of good conscience to remain silent." . . . don't remain silent . . . VOTE out da bums!

Obama's Inheritance

OK, it’s been a while since I submitted a rant but today, as I watched the news, I heard another Obammunist apologist attempt to re-write history in Orwellian 1984 style by pointing out that Mr. Obama “inherited” the massive problems we are now facing in a transparent attempt to “lay the blame” on President Bush and the Republicans. Well there’s plenty of blame to go around, and some definitely belongs to both of them but maybe it’s time for a little non-Orwellian, non-revisionist history.

Most of our present problems with illegal immigration stem from the 1960 Presidential election when, in order to get their support for his election, John Kennedy made a deal with the unions to weaken the Bracero Program (1942-1964) which had allowed Mexican migrant workers to temporarily enter the United States to work (mostly during harvests in agriculture) and which weakened their hold over agriculture. Actions on the part of the Kennedy and later Johnson Administrations cynically disguised as provisions to insure minimum levels of wages, housing, food, and medical care (paid by the sponsoring employer) had the effect, by 1964, of eroding support for the program by the agricultural sector for the legal importation of workers from Mexico in favor of hiring Illegal immigrants to reduce overhead costs. Both Kennedy and Johnson were Democrats.

Our dependency on foreign oil and the energy crisis we are currently experiencing are a direct result of 40 years of moronic, ill advised, poorly constructed legislation by politicians and presidential administrations in an attempt to placate and curry favor and the support of liberal, left wing wacko environmentalist which have placed the majority of our natural resources off limits and dead-stopped the construction of oil refineries. The greatest majority of these domestic energy industry gutting legislations were the product of Democrats and Democrat Administrations.

The present wars in Iraq and Afghanistan and the entire “War on Terrorism” are a direct result of the attack on the United States on September 11^th, 2001 by Al-Qaeda radicals who had taken a pledge of loyalty to Osama bin Laden. In 1995, six years before the act, President Clinton was literally offered bin Laden on a silver platter by the Sudanese but turned down the offer . . . President Clinton was a Democrat.

Our present financial crisis finds its roots in the revocation of Glass-Steingold Act of 1933 which mandated the separation of Commercial and Investment banks and created an environment for invest banks to become involved in high-risk, unprotected behavior without the controls that commercial banks operate under. The act of revoked under the Clinton administration . . . Clinton was a Democrat.

The eminent demise of the American auto industry that we are witnessing IS NOT the result of “Detroit not building cars the American people want to buy.”, open your eyes and look around you, the American people have shown over and over that they DO want the vehicles that Detroit is building . . . they (1) can’t afford to drive them because of the destruction of our domestic energy industry and (2) Detroit can’t produce its vehicles at a competitive cost to “guest” auto manufacturers. An unholy triumvirate has, over the past 30 years, joined together in various actions which have raised the manufacturing costs of American vehicles 30 to 40% higher than “guest” manufacturers typically see and which in turn have reduced profit margins on American vehicles to dangerously low levels. This triumvirate consists of the UAW, left wing environmentalist, and the Democrat party.

The collapse of the housing market was precipitated by Community Reinvestment Act of 1977 which pushed banks to make loans to individuals which would have, without the pressures of the act, been considered “bad risks” and who they would not have made loans to. The act was pushed into law by the Carter administration and a Democrat Congress. . . Carter was a Democrat.

The skids under the collapse were further greased by the idea that every American was “entitled” to own his/her own home . . . this idiotic, left wing, liberal idea most closely identified with the Democrat party.

The steepness of the collapse was increased by the implosion of Fannie Mae and Freddy Mac due to their issuing of massive numbers of sub-prime loans to individuals who never should have even been considered for loans while Barney Frank, Maxine Waters, Christopher Dodd, and others extolled their success and praised their management . . . Frank, Waters, and Dodd are democrats.

The ill conceived bailouts and recovery acts we are now seeing find their roots prior to the national elections of 2008 . . . both houses of Congress have been controlled by the Democrats for almost 2 years.

While we’re at it a few other points . . . the language that allowed the AIG bonuses the bozos in Congress are complaining so loudly about were inserted into the 1100 page stimulus bill by Senator Christopher Dodd which none of them bothered to read . . . Dodd is a Democrat and both houses of Congress are controlled by Democrats.

Yes, President Obama did inherit these massive problems and this crisis . . . his inheritance is not solely from Mr. Bush and the Republicans but is in a greater part a legacy from his Democrat progenitors.

Just one or two other thoughts . . . all of you Democrats, Republicans, and yes, even you Obammunist sheep need to take a class on the constitution. I’m no constitutional scholar but anyone with a high school education knows that law you just passed, you know the one that you’re hoping will divert everyone’s attention away from the fact that this problem resulted from your malfeasance and incompetency . . . the one that taxes those evil AIG executives 90% on those evil bonuses is an ex post facto Bill of Attainder which is so totally unconstitutional (Article 1, Section 9, Paragraph 3) as to be laughable if it weren’t such a dangerous precedent. By the way if I hear one more Congressional talking head trying to excuse passing this putrid American Recovery and Reinvestment Act without reading it because it was 1100 pages long and they didn’t have enough time or because “ . . . no one in Washington reads all of these things . . “ I’ll scream. How can they possibly vote for or against something they haven’t read . . . I thought that was what we paid them for! How about a “truth in legislation” act that totally outlaws “earmarks”, forces bills to be written in un-convoluted, plain English, and limits the page size to something these bozos CAN read!

And while we’re at it how in the heck can Congress chide corporate executives for flying around in private jets paid for by their stockholders when Nancy Pelosi flies around herself, her staff, her family, and her friends in a private jet provided and funded by the American tax payer. Lastly, while I’m on Nancy Pelosi, in what bizaaro world does it make sense to allow someone who gives a speech to illegal aliens in which she praises these lawbreakers for being “ . . . true patriots . . “, and that “ . . . enforcement of existing immigration laws is un-American” serve in Congress let alone be Speaker of the House and third in line for the Presidency? This left wing wacko needs to sit herself down, write a letter of apology to every American and legal immigrant, resign from office, and expat to Mexico City.

2010 will be an election year and I think it’s time to send a message to Washington . . . the people whose incompetencies have caused all these problems will be running for re-election . . . maybe it’s time to impose populace term limits. The founding fathers envisioned a government of “citizen legislators” not career politicians so I think it’s time to vote for the other guy, no matter what party the other guy belongs to, and not put even one of these bozos back in office and keep doing that until we get back to citizen legislators.

When will they come for you?

What happened in Texas during April of 2008 is nothing new; we've seen it all before. A prominent German theologian and Lutheran pastor, Martin Niemoller, penned a warning to future, unborn generations which was first published in the book "They Thought The Were Free" written by Milton Mayer in 1955.

I am not a member of the FLDS church, I am not a proponent of polygamy (I have enough trouble managing one wife and one family), I do not ascribe to the tyrannical methods employed by the patriarchs of some FLDS families, and I abhor the abuse of children but I definitely believe that those misguided individuals in this country who are applauding the actions in Texas need to read, understand, and take to heart the message of that book and Niemoller's poem:

First they came for the communists, and I did not speak out—
because I was not a communist;

Then they came for the socialists, and I did not speak out—
because I was not a socialist;

Then they came for the trade unionists, and I did not speak out—
because I was not a trade unionist;

Then they came for the Jews, and I did not speak out—
because I was not a Jew;

because I was not a Catholic;

Then they came for the Protestants, and I did not speak out —
because I was not a Protestant.

There are those who will applaud the actions of Texas officials because they will espouse that "the ends justify the means", and there are those (like the speaker in Niemoller's poem) who will ignore what's going on because it doesn't affect them and then there are those who will feel insulated from what is going on because we (unlike Nazi Germany) are a country of laws and are protected by a constitution and thus immune from the arbitrary and capricious whims of evil minded leaders. They are all three wrong.

The ends NEVER justify the means. What's happening in Texas DOES affect each and every one of us. The constitution IS regularly ignored by police agencies and the courts whenever doing so serves some ultimate, perceived good.

Where's Sarah?

The precipitative events in El Dorado Texas were initiated when a supposed call for help from Sarah; a pregnant 16 year old, forced child bride (who also had an 8 month old baby) was received by Texas authorities. In her plea for help she reported forced marriages, physical abuse, rapes, and beatings and she identified her abuser, her much older husband, by name. Surely enough information to identify her, yet weeks after hordes of body armored, automatic weapon packing stormtroopers invaded the community the authorities have yet to produce Sarah; why? Except to the most naive or malevolent observer four possible answers present themselves (1) the authorities are totally inept and incompetent and can't identify a pregnant 16 year old girl with an 8 month old baby even when they know her first and second name and the name of her "husband" (2) Sarah isn't her real name and even though she has been rescued and is safe she's too afraid to self identify (3) Sarah never existed, the authorities have been duped by a malevolent third party, possibly a former member of the sect or (4) Sarah never existed and the authorities fabricated the complaint as an excuse to attack and destroy a community that holds non-traditional religious and family beliefs. After having observe, over the course of my lifetime, the steady erosion of the constitution and the willingness of our leaders and the courts to embrace the notion that the "ends justify the means" I favor either answer 3 or 4. Both these possibilities embrace the apparent current, unverbalized (yet prevalent) philosophy in the American "justice" system that its ok to violate the constitutional rights of some individuals if those violations can be cynically cloaked as supporting some "higher good" or protecting some real or imagined "innocents".

I'm sure at some point the "authorities" will parade out "Sarah"; now "Sarah" might not be 16, she may not be married to the man first identified, she might not even be married or be pregnant or have children and her name may not even be "Sarah" but you can be sure that she will be well schooled on what to say, when to whimper, and when to break down in tears as well as when to be courageous in her stance. The authorities have to produce a "Sarah" in order to justify their violation of the constitutional rights of hundreds of individuals, the invasion of an American community by armed "troops", the desecration of a community's most religious site, the destruction of dozens of families and as a defense against the possible litigation that may result from these draconian actions. While no one would, nor should, deny that individuals who commit rape, force minors into marriage, abuse children, wives, or anyone; whether under the guise of religious practices or not, should be prosecuted to the fullest extent of the law, that prosecution should be executed with the strictest compliance to the constitution if we are to remain a truly free nation governed by law and not popular opinion. Extreme reaction as we've seen in Texas should require more than an anonymous complaint to be initiated, victims need to be actual persons identified by name, and perpetrators need to be individually identified not identified as a member of a faceless mass; actions such as these are actions used by despots to persecute dissidents, "enemies of the state", or non-conformists not the actions employed by those that sit in judgment of a free people to prosecute criminals.

The Background

Before I go on let me say that over the years I have made literally hundreds of online purchases with no problems and that there are probably tens of thousands of legitimate, small, honest e-merchants selling every conceivable product who are eager to set right any problem's a customer might run into. What follows isn't about them its about the few bad eggs.

A few days ago I decided I needed a better digital camera so I turned to the internet, as I normally do, for research and decided that a Canon Powershot S5 IS filled all the criteria I was looking for in a camera. After checking prices at several "brick and mortar" merchants my next step, as I have done hundreds of times in the past with other items, was to Google "Canon S5 IS" to check on online pricing. My google search returned some 636,000 hits. I selected the first one on their list, www.lowpricedigital.com (which is one of those outfits that provide prospective buyers with information about pricing for contemplated purchases, links to e-merchants selling the product and a rating for each listed merchant). I clicked on Broadway Photo (www.bwayphoto.com) their "best value" choice mechant, rated with "five stars" and a "Customer's Trust Award" winner and was swiftly whisked to Broadway's web page featuring the Canon Powershot I was looking for price at $281 and included free shipping. The base price of $281 was anywhere from $40 to $188 cheaper than every legitimate "brick and mortar" and e- merchant that I'd checked out. This didn't raise a red flag as I found many great deals on the internet over the years . . . this didn't turn out to be one of them.

The "Brooklyn Shuffle"

I've dubbed this scam the "Brooklyn Shuffle" because after getting slammed by it I did a considerable amount of research and discovered that a large number of the shady e-merchants pulling this e-commerce spin on the old "bait and switch" were located in Brooklyn besides it sounds cool . . .the "Brooklyn Shuffle".

Before I explain this scam a few definitions as used here would be helpful :

Bait advertising - According to the FTC (16 CFR Part 238.0) bait advertising is an alluring but insincere offer to sell a product or service which the advertiser in truth does not intend or want to sell. Its purpose is to switch the consumers from buying the advertised merchandise in order to sell something else, usually at a higher price or on a basis more advantageous to the advertiser. (I would add to that " . . . or to "up-sell" the customer additional products or services at wildly, inflated prices to make up for a "loss leader")

Loss Leader - A type of pricing strategy where an item is sold below cost in an effort to stimulate other, profitable sales (in the case of this scam, the "Up-sell").

Low ball(ed) - A drastically reduced price on merchandise offered for sale used to attract prospective victims of this scam.

Up-Sell - A sales technique whereby a salesperson attempts to have the customer purchase more expensive items, upgrades, or other add-ons in an attempt to make up for lost profits from "low balled" or "loss leader" merchandise. In most cases up-selling is a legitimate sales tool which provides additional useful products to a customer however when used as part of this scam "up-selling" usually involves selling inferior products at wildly inflated prices in a cynical attempt to recover any diminished profit the e-merchant suffers on the "low balled", "bait" merchandise.

Drop Ship - Drop shipping is a legitimate supply chain management technique in which the e-merchant does not keep merchandise in stock, but instead transfers customer orders and shipment details to wholesalers as transactions occur, who then ships the goods directly to the customer . The e-merchants make their profit on the difference between the wholesale and retail price and the money saved by not holding inventory.

Gray Market - Gray market merchandises are not generally illegal, they are being sold outside the distribution channels intended by the producer or manufacturer. Manufacturers will typically produce nationalized versions of their products designed to be sold in different countries or regions at highly disparate prices. These "nationalized" products are produced to comply with local laws, often contain instructions in the native language only, and in the case of electronics goods and photographic equipment conform to local power standards. The "gray marketeer" hopes to make a greater profit by purchasing products in a country where the price is very low and selling them in a country where the product sells for a much higher price. One drawback of the gray market is that many manufacturers will not honor warranties on electronics and photo equipment purchased through it. Another drawback in electronics and photo equipment is that the graphics associated with the merchandise's use maybe solely in a foreign language.

Here's the way this scam works in general:

An e-merchant offers items for sale at "low ball", bait prices; the merchant then follows an order received with a "verification" phone call and/or email which is in reality a thinly veiled attempt to "up sell" the customer additional, wildly overpriced accessories or services designed to offset the "low balled" or "loss leader" selling price of the "bait" and garner the scammer a larger profit. If the customer purchases sufficient "up sale" the "bait" product (which can be "gray market" merchandise) and the "up sold" accessories are shipped; if not the customer will later receive an "out of stock" email informing him or her that the product will ship at some protracted future time, usually 3 to 8 weeks. This delivery delay is usually designed to be of a length of time as to solicit a cancellation by the customer. The customer is also given the option to cancel the order at this point and this email will also normally contain a notice that the customer's "credit card will not be charged until the merchandise is shipped" in an attempt to escape claims of fraud. If the customer doesn't cancel the order he or she goes into perpetual back-order until eventually the order is canceled. And that kiddies is how we do the "Brooklyn Shuffle" . . . bottom line, if you don't by the "up sells" you don't get the "bait" product.

Now to pick up with my experience with two e-merchants

I placed my order with Broadway Photo on their website attempting to purchase the Canon Powershot S5 IS camera for the advertised price of $281 with free shipping. This outfit is really on the ball, within hours of placing the order I two emails and an answering machine message asking me to call their 1-800 number to "verify and process your order". I called the number and after a 5 or 10 minute on hold was connected with a "customer representative" who asked me to verify my mailing and shipping address and then launched into the "up-sell". First he informed me that the alkaline batteries that come with the camera would only last about 10 minutes and he was going to help me out by selling me 4 NiMh rechargeable batteries and a recharger for $79 (later I researched legitimate merchants and discovered the average cost of 4 NiMh batteries and changer was about $20). Since the alkaline batteries would only last 10 minutes (quick someone call Canon and tell them they have a design problem) I agreed to the NiMh battery offer (after all what good was a camera the only worked for 10 minutes). No sooner had I agreed to this "up-sale" then this guy launches into a sales pitch for a "deluxe digital camera accessory kit which included not only the NiMh batteries and charger but also LCD screen protector and additional SD card, blah, blah, blah and extended warranty". Now, sometimes I'm a little slow on the up take but it dawned on me, bling . . . this isn't a "verification" phone call its a sales pitch, so I tell the guy I've changed my mind and decided not to buy the batteries and charger or anything else and just wanted the camera for the original $281 and free shipping. The guy at the other end of the phone now comes unglued and launches into a hysterical tirade accusing me of shouting at him and disrespecting him when all he was trying to do was help me out and make me some good deals (disrespecting him? I thought I was the customer and deserved respect!). By this time I found myself totally off balance but I found my center an calmly proceeded to explain that I wasn't shouting nor disrespecting him . . . I just wanted to get back to my original order; a Canon PowerShot S5 IS digital camera for $281 and free shipping. After a few more comments about how he was just trying to do whats best for me and threats on his part to cancel my order because of my abrasiveness he graciously accepted my order and the phone call ended. Within hours I received an email from Broadway Photo which read as follows:

"This e-mail is being to sent to update you on the status of your order # xxxxxxxx. Your credit card had has not been charged due to the fact that the product you ordered is currently on back-order. When the product arrives we will e-mail you and then process your order.

For updated order status, shipping and tracking information visit the "My Account" area of bwayphoto.com or you may e-mail us at suuport@bwayphoto.com. Click here to cancel your order.

We apologize for any inconvenience."

After all I had been through with this outfit I clicked the cancel link and canceled the order, after all right above them on the LowPriceDigital webpage was 86th Street Photo and Video (www.86photovideo.com) which was selling the same camera for $245 plus a $14.95 shipping charge to my zipcode (mmm that comes to $259.95 how did LowPriceDigital come up with Broadway as the "Best Value"?)

The "Brooklyn Shuffle"? I'll leave that up to you, the FTC, the New York State Attorney General's Office, the Kings County District Attorney, and the New York Better Business Bureau to decide . . . I know what my opinion is, can you guess?

My efforts to procure the Canon PowerShot S5 IS digital camera I coveted now turned to 86th. St. Photo & Digital, after all LowPriceDigital did give them "5 stars", calls them a "Certified Merchant", identifies them as a "Featured Merchant" (funny the "name brand" merchants, Amazon and RItz camera, aren't "Featured Merchants"! Hmmm do I begin to smell a rat?) and their price for the camera with shipping is $259.95 which is some $21.05 cheaper than their "best value" merchant . . .what a deal. Off to their website I go, a few keystrokes, and bingo the camera of my recent dreams is within my reach . . . well almost!

Shortly after placing my order with 86th St. Photo & Digital I received an email from them:

"We thank you for choosing 86th St. Photo & Video as your choice for all your photographic equipment.

In order to further verify your order, we will need to speak with you on the phone. Please call our Verification department at 1-800- Ext. 999 so we may verify and complete processing your order."

Hmmm, this sounds vaguely familiar! Seriously, after my last experience with Broadway Photo I was prepared for this one . . . out came my old tape recorder, on went the speaker phone, push the buttons and dial the number. Within minutes I was speaking to of 86th Street Photo's "verification department", push the record button. I verified my shipping and billing addresses. " Is that all?" "Yes, oh wait I don't know if you noticed but you didn't order any batteries!". I explained I didn't need batteries I had them and a rechareger, that I didn't need a high speed SD card, didn't need filters, didn't need, didn't need, didn't need. With a bit of disappointment in his voice the "verification" person finally said . . "Well thats it I guess your all set". Before we end the phone call I ask if the camera is in stock, the "verifier" assures me that their is no problem with stock as they (86th St. Photo & Digital) are a "drop shipper", I respond asking if I can expect the camera to ship in the next couple of days, the verifier tells me the there's no problem he works in the "verification department" and can state it will.

Wow, I'm going to get my camera in three days for $259.95 and no up sales . . . not so fast!

No sooner did I hang up then I checked my email and guess what an email from 86th St. Photo & Digital . . . a shipment notification??? In your dreams:

"This notification is sent to you from our shipping department.

We regret to inform you that by the time your order reached the shipping process, our inventory on the product(s) you ordered was negative, therefore your order will be placed on a temporary backorder until we receive the product(s) back again in stock which will be in about 3-4 weeks.

Please note that your credit card will not be charged, as long as, your order has not shipped.

You can modify and/or cancel this order at any time before it is shipped without incurring any charges or fees to your account.

To cancel your order you may do so by logging into your account online:
1- login to your account online at www.86photovideo.com with your email and password (if you haven't created login information when you placed your order you may register at the following link to view your account https://www.86photovideo.com/shop/login.asp?gotoloc=, or you can reply to this email with login info request and we will provide you with same.

Now I'm getting a little pissed so I shot back the following email:

"I have just received an email concerning my order,999999-X, in it I was notified that my order has been "back order" because "your inventory on the product(s) you ordered was negative". I think you maybe mistaken as to the availability of this item since this item is "drop shipped" from your supplier and not shipped from your inventory
(please review the recording of my conversation with Kevin of your "verification department" confirming this and in which I was assured that my order would be filled immediately); I therefore fully expect that my order will be filled WITHOUT delay at the $245 price and that I will be receiving the equipment I ordered in the 3 business day period
I contracted for not after the 3-4 week delay which would be necessary if it were being shipped from inventory. A copy of this dialogue is being retained for future reference. Thank you."

Talk about playing dumb, they respond with:

"We regret to inform you that the products you have ordered with our company are sold out temporarily.

However, these products shall be available again within about 6-8 weeks from the date of this email. We would like to notify you that we still have not charged your credit card as of yet. Once we have the products ordered available again, we will send you another email notification and only then, you will be billed 24 hours prior to products shipment.

If you would like to be on the backorder list for this product(s), just reply to this e-mail with the phrase “Please backorder order# (________) in the subject.

If you would like to cancel the order just reply with the phrase “Please cancel order# (__________) and we will take care of the rest and destroy current information about your order.

Thank you for your business!

Not only did they ignore everything I said, not only did the fail to explain how how a "drop shipper" can be "sold out temporarily", but they also doubled the delay time!

This time I didn't cancel but did some homework and shot back:

"Re-read my comment to you, your agent "spilled the beans" . . . you "drop ship" from your wholesaler therefore it is highly unlikely (read nearly impossible) that you are "sold out temporarily". I've googled you and have found hundreds of legitimate complaints about you pulling this same "bait advertising" in the past. Before you feign offense let me enlighten you of the FTC's definition of "Bait advertising" as defined in Sec. 238.0 of 16 CFR Part 238:

"Sec. 238.0 Bait advertising defined.

Bait advertising is an alluring but insincere offer to sell a product or service which the advertiser in truth does not intend or want to sell. Its purpose is to switch consumers from buying the advertised merchandise, in order to sell something else, usually at a higher price or on a basis more advantageous to the advertiser. . . ."

In this case in researching you I find a consistent and deliberate pattern of offering items for sale at "low ball" bait prices, following orders received up with "verification" phone calls which are in reality thinly veiled attempts to "up sell" the customer additional wildly overpriced accessories or services designed to offset the "low balled" selling price of the "bait" and garner a large profit; if the customer purchases sufficient "up sale" the "bait" product and the "up sold" accessories are shipped, if not the customer receives an "out of stock" email informing him or her that the product will ship at some protracted future time. This delivery delay is usually designed to be of a length of time as to solicit a cancellation by the customer. The customer is given the option to cancel the order this email will also normally contain a notice that the customer's "credit card will not be charged until the merchandise is shipped" in an attempt to escape claims of fraud.

I would like to point out to you Sec. 238.2 16 CFR Part 238:

"Sec 238.2 Initial offer.

(b) Even though the true facts are subsequently made known to the buyer, the law is violated if the first contact or interview is secured by deception."

You offered a product for sale, I ordered the product, you are a "drop shipper" these are the truths I expect to receive a return email informing me that the product I ordered; a new, U.S. warrantied Canon S5 IS Digital Camera has been "dropped shipped" from your wholesaler to arrive at my residence in the 3 business days I contracted for and with a tracking number which I can use to confirm shipment and track its progress."

And asked the New York Better Business Office to help resolve this issue. Its been 52 hours since I sent e-mail to 86th St. Photo & Video and I sill haven't gotten a reply from them and 24 hours since I contacted the NY BBB; will either do any good . . . with a reputable e-merchant I'd say yes . . . with these yahoos (with apologies to Yahoo which has nothing to do with this and is an excellent, reputable company) probably not but I can tell you this I intend to push this.

The "Brooklyn Shuffle"? I'll leave that up to you, the FTC, the New York State Attorney General's Office, the Kings County District Attorney, and the New York Better Business Bureau to decide . . . I know what my opinion is, can you guess?

How to avoid getting took

Avoiding the "Brooklyn shuffle" and most other online, e-commerce scams is really quite easy and only takes a couple of minutes of your time, just follow these rules:

1. If it sounds too good to be true it probably is - this should be your first clue that something isn't right. If the site is

offering a product at a price thats way cheaper than anyone else it may be a scam or a "gray market" product. Check them out before placing an order.

2. Be suspicious of strangers - If you are contemplating dealing with an e-merchant you've never dealt with before

contact the Better Business Bureau (www.welcome.bbb.org) and visit both their national site and, if you know

where the e-merchant is located, the BBB in their location and check them out. They've made it pretty easy (kudos to you BBB), you can search for BBB reports by company name, company phone number, website URL, business category (a little useless by itself), and optionally with street address and city. Enter the information you have, hit search and in seconds you can have a report on the e-merchant; the best thing is YOU CAN TRUST THE BBB! If the BBB has negative comments, avoid the outfit like the plague.

3. Don't believe the "merchant ratings", "store ratings", and "customer ratings" - You don't know who owns those

sites that "Compare Prices and Shops" and provide the merchant and store ratings; you don't know who really

is providing those "customer" ratings. One "Compare Prices and Shops" site I investigated rated a "Brooklyn Shuffle" e-merchant as "5 star", "Premium Seller", and a "Trusted Seller" . . .the site linked to 5036 customer reviews on this scammer, all glowing and positive; however, strangely when I googled this :Trusted Seller" I found page after page of "Brooklyn Shuffle" and "Gray Market" complaints against them and the BBB listed them as a "non-accredited business" with an "unsatisfactory record with the BBB". Who do you think wrote those glowing "customer reviews"?

4. Check out what previous customers say - As I said above, "you don't know whose writing those glowing customer
reviews" but you can probably trust the real customer community . . . google the business, if someone has had a
problem with the e-merchant it will probably be on the internet, if you see a consistent, pervasive complaint stay
clear of the bums or be prepared to be scammed.

If you go through these steps and the merchant checks out, go for it . . there are tens of thousands of hard working, honest e-merchants on the internet providing goods and services at great prices

But

If you come across any of the questionable e-merchants mentioned during your e-commerce dealings pass them by. If you currently are involved with them and think you're a victim of the "Brooklyn shuffle", FILE A COMPLAINT WITH: the New York Better Business Bureau (www.newyork.bbb.org), the State of New York Attorney General's Office (www.oag.state.ny.us), the Kings County District Attorney (www.brooklynda.org). and the Federal Trade Commission (www.ftc.gov) and demand that they be prosecuted!
